Assessing someone’s legal capacity to sign certain documents, such as a Will, Power or Attorney, or Healthcare Proxy is a vital first step to any successful plan involving an elder or adult with special needs. If your loved one does not have the capacity to handle their own affairs, and he or she did not sign a Power of Attorney prior to losing such capacity, the Court needs to appoint a guardian to help them. As a general matter, drafting and executing estate documents is far less expensive and time consuming than pursing a guardianship in Court.
